Probate is the legal process that occurs after someone passes away. In Texas, probate ensures that the deceased’s assets get properly managed and transferred to their heirs or beneficiaries, providing a structured way to handle estate matters.

Probate refers to the legal process of validating a will and administering the deceased’s estate. The executor handles managing and distributing the estate under the will’s provisions. 

If someone dies intestate, meaning without a valid will, Texas laws dictate how the estate gets distributed. The estate encompasses all the assets and liabilities owned by the deceased, including real estate, bank accounts, and personal property.

Steps in the probate process

The probate process starts with filing the will with the probate court in the county where the deceased lived. If no will exists, the court applies intestacy laws to determine the distribution of assets. The court then appoints an executor if the will does not name one. This person manages the estate, pays outstanding debts, and ensures proper asset distribution.
